Terms of Use
Key'ndergarten Teacher Toolbox · Effective October 5, 2026
These terms are an agreement between you and Deniz Wong, 148 Horton Street, Fall River, MA 02723, USA ("we", "us"), for the Key'ndergarten Teacher Toolbox app for iPad (the "App") and the related online service at https://keyndergarten.app (together, the "Service"). By creating an account or using the App you agree to these terms and to our Privacy Policy.
The Service
The App gives piano teachers interactive activities and whiteboard tools to use with their students in lessons. We continue to develop the Service and may add, change or remove activities and features.
Your account
You must be an adult (18 or older, or the age of majority where you live) to create an account. Keep your password confidential; you are responsible for activity under your account. Please give us accurate information and keep your email address up to date so that password reset links reach you. You can delete your account at any time in the App or at https://keyndergarten.app/account/delete.
Subscriptions and free trial
- Full access requires a subscription, offered monthly or yearly as an auto-renewable subscription through Apple's App Store. Prices are shown in the App before you buy.
- New subscribers may be offered a free trial of 7 days. If you do not cancel at least 24 hours before the trial ends, it converts into a paid subscription. Eligibility for a free trial is determined by Apple.
- Payment is charged to your Apple Account when you confirm the purchase (or when the free trial ends).
- Your subscription renews automatically for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription in your iPad's Settings under your Apple ID → Subscriptions. Deleting your account does not cancel a subscription.
- Purchases are processed by Apple. Refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com.
License and content
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, as permitted by Apple's Usage Rules, for teaching your own students. The activities, graphics, sounds and texts are protected by copyright and belong to us or our licensors. You may use drawings and PDF exports you create with the whiteboard tools for your own lessons and students. You may not copy, resell, redistribute, or publish the App or its content, reverse-engineer the App except as permitted by law, or use the Service in a way that harms it or other users.
Availability and changes
We work to keep the Service available, but it may sometimes be interrupted for maintenance or reasons beyond our control. Most activities work offline once the App is set up; signing in, syncing and purchases require an internet connection.
Disclaimer and limitation of liability
The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, and we are not liable for indirect, incidental or consequential damages, or for loss of data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid for the Service in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, or any mandatory rights you have as a consumer in your country.
Ending these terms
You may stop using the Service and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms; where possible we will tell you first. Sections on license restrictions, disclaimers and liability continue to apply after the terms end.
Apple
These terms are between you and us, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for it. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App. We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims, and for the investigation, defense, settlement and discharge of any third-party claim that the App infringes intellectual property rights. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the App. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict of laws rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.
Changes to these terms
We may update these terms. We will change the date above and, for important changes, let you know in the App or by email before they take effect. If you continue to use the Service after that, the updated terms apply.
